On November 24th, 2008, a new Federal Regulation (Part 643 of CFR23) will go into effect regarding high-visibility safety apparel. All workers within the right of way of a Federal Aid Highway, who are exposed to traffic or construction equipment within the work area, are required to wear Class 2 or Class 3 high-visibility safety apparel.
This law was enacted to respond to the increase in injuries and fatalities caused by motor vehicles and construction equipment while working within the right of way of a Federal Aid Highway. It affects workers who are, Towing and Recovery Professionals, Highway Construction and Maintenance Professionals, Utility Professionals and Traffic Management Professionals. In order to be in compliance with this new regulation, you must wear Class 2 or Class 3 ANSI/ISEA 107-2004 safety apparel. This could be a vest short or long sleeve T-shirt, sweatshirt or jacket.
